📮📢 Solicitor’s Letter Issued to NNC

We wanted to make you aware that a letter of objection has been issued by Goodenough Ring Solicitors to North Northamptonshire Council (NNC), instructed by the Stanton Cross Residents’ Association (SCRA).

This action is not a collective civil action, nor is it pursuing individual claims. It is a formal representation made by the SCRA to ensure that the interests of the wider community are fairly considered.

📝 What the letter is about
The letter asks NNC to refuse a proposed change to the Section 106 Agreement that would delay delivery of a supermarket and retail units from the occupation of the 1,200th home to the 2,000th home.
The letter argues that:
• The developer is already in breach of the existing obligation because more than 1,200 homes have already been occupied.
• The request to vary the agreement is procedurally flawed, lacking proper consultation, notice, evidence, and transparency.
• The developer has provided insufficient evidence to justify the delay, and what is provided is weak and unsubstantiated.
• Delaying the amenities would have negative impacts on residents, who were promised these facilities much earlier.

🏛️ What the solicitors are asking the council to do
The letter requests that NNC:
1. Reject the request to vary the agreement,
2. Enforce the existing obligations (potentially via injunction), or, if it chooses not to enforce,
3. Use its powers to carry out the works and recover costs from the developer.
It also requests disclosure of all relevant communications between NNC and the developer under the Environmental Information Regulations.
